End-User License Agreement

1. Agreement

This End-User License Agreement ("Agreement") is between you ("User") and Apex Auto Repair LLC ("Company") governing your use of the Apex Auto website and dealer management services at theapexauto.com ("Service").

2. Use of Service

The Service provides vehicle inventory browsing, vehicle purchasing tools, financing calculators, and dealer management capabilities. By using the Service, you agree to:

  • Provide accurate and truthful information
  • Use the Service only for lawful purposes
  • Not attempt to gain unauthorized access to any part of the Service
  • Not interfere with or disrupt the Service

3. Electronic Signatures

By using our electronic signature feature, you acknowledge that your electronic signature is legally binding and equivalent to a handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA).

4. QuickBooks Integration

Our Service integrates with Intuit QuickBooks for accounting purposes. By authorizing this connection, you consent to the transfer of relevant financial data between our Service and QuickBooks as described in our Privacy Policy.

5. Vehicle Information

While we strive for accuracy, vehicle information including pricing, specifications, and availability is subject to change without notice. All vehicles are sold subject to prior sale.

6. SMS / Text Messaging

If you provide your mobile number and opt in — by checking the SMS consent box on a form on this website, or by signing a financing agreement that contains SMS consent language — you consent to receive SMS/text messages from Apex Auto Repair LLC related to your inquiry, including vehicle availability, financing updates, appointment scheduling, account or vehicle notifications, and customer support. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out at any time, or HELP for help. Consent is optional and is not a condition of any purchase, financing, or service. We do not sell or share your mobile phone number or your SMS opt-in consent with any third parties or affiliates for their own marketing or promotional purposes. 7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Company shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.

8. Governing Law

This Agreement is governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Orange County, Florida.
